Asylum Applicants Work Authorization Application Filing Dates

Effective on August 21, 2020 asylum applicants can file their renewal work authorization applications up to 180 days before the expiration date. The rule removes the requirement that asylum applicants submit their work authorization renewal requests to USCIS 90 days before the expiration of their current employment authorization.

Heavily Weighted Negative and Positive Factors for Public Charge Inadmissibility

On or after February 24, 2020 the U.S. Department of Homeland Security begin to implement nationwide the inadmissibility on public charge ground rule. The final rule applies to an applicant for admission or adjustment of status or visa. The applicant must prove that he is self-sufficient. The applicant who is likely at any time to become a public charge is inadmissible.

H1B Fiscal Year 2020 Visas Premium Processing

Petitioners requesting a change of status for FY 2020 cap-subject H-1B petitions may concurrently file request for premium processing on April 1, 2019. If petitioners do not file request for premium processing concurrently, the petitioner must wait until premium processing begins to submit such request.

H1b Visas Selection New Regulation

Starting April 1, 2019, US employers who want to hire foreign works on H1b visa will be required to register with USCIS during registration period. USCIS will select registrations submitted on behalf of all foreign workers. Then USCIS will select from the remaining registrations sufficient numbers of applications eligible for the advanced degree exemption.

USCIS Policy of Calculating Unlawful Presence of F, J, or M Students

USCIS is changing how the agency calculates unlawful presence for F-1, J-1, and M-1 nonimmigrants and their dependents (F-2, J-2, and M-2 nonimmigrants). On or after August 9, 2018 individuals in F, J, or M status who fail to maintain their status, will start accruing unlawful presence on the earliest of any of the following:

US Citizenship Interview

USCIS begins using digital tablets during US citizenship interviews. Digital tablets will be used

to administer the English reading and writing tests. Immigration officers will be able to continue using the paper process on a case-by-case basis.

U.S. Citizenship and Immigration Services (USCIS) issued new policy memorandum on issuance of notice to appear (NTA) and putting individuals into removal proceedings. An NTA is a document that instructs an individual to appear before an immigration judge. This is the first step in starting removal proceedings.

A student on a 17-month STEM OPT extension may apply to add 7 months to his STEM OPT period. USCIS will deny applications filed after August 8, 2016.
